LAWRENCEVILLE — Records show a Norcross woman is being deported after her young daughters were found wandering alone near Beaver Ruin Road this week.

Norcross police arrested Yesenia Vargas, 23, on charges of first-degree child cruelty and reckless conduct. The allegations state that Vargas left her daughters, whose ages are roughly 2 and 3, alone at their Stanford Village Lane apartment for six hours Tuesday night, when they wandered away.

A neighbor called police about 11 p.m. to report the children were found near Beaver Ruin Road and that no one was home at their apartment. The neighbor had waited about an hour for someone to come home before calling police, according to a Norcross police report.

One girl told police her mother worked at McDonald’s, so officers were dispatched to McDonald’s restaurants in the area but could not find the mother. A worker with the Division of Family and Children Services came to police headquarters and took custody of the girls, the report states.

At 3 a.m., Vargas called police and was told her children were in state custody. She claimed that when she’d left the home to pick up her cousin, the girls were sleeping, so she locked the home and slipped out, expecting to be gone a short time, the report states.

“(She) said that in the process of picking up her cousin she ran out of gas and had to wait for someone else,” an officer wrote in the report.

The officer found Vargas’ story “very inconsistent” and that she’d shown “absolute disregard” for the children. On Wednesday morning, police came to Vargas’ apartment and arrested her.

According to jail records, Vargas is a native of Mexico and is being held without bond for Immigration and Customs Enforcement authorities.

This is the exact scenario for which the word "jurisdiction" in the 14th Amendment means that this woman AND her children are NOT citizens of the USA. By deporting this women we are returning her to the jurisdiction of the country she is a citizen of. It is completely wrong and immoral for her children to be taken from her. If the word "jurisdiction" in the 14th is taken to mean that US born children of foreign diplomats are NOT citizens of the USA how can the children of illegal aliens not be covered by this same word ???

"Wrong and immoral" to take away her kids? What she did is wrong and immoral. First, she left her kids, then she lied about it. She's here illegally and needs to go back home. Are her kids not going with her? I would hope that they are....deport them all. Let her country deal with her....and her kids. Where's dad, by the way.....?
