Sugar Hill man charged with DUI with child in car

SUGAR HILL -- A Sugar Hill man was arrested over the weekend for allegedly driving the wrong way on Level Creek Road with his young daughter in the car, his third DUI charge in Gwinnett over the span of less than a year.

Rodolfo Delacuesta, 42, was arrested Saturday and charged with driving under the influence, DUI-child endangerment and open container. According to a Gwinnett County police report, a witness reported seeing Delacuesta driving down the wrong side of Level Creek Road at about 8:15 p.m.

Police made contact with him in the parking lot of a liquor store near the intersection of West Broad Street and Ga. Highway 20. He was determined to be under the influence there and arrested.

Delacuesta's 8-year-old daughter was in the car.

According to Gwinnett County Jail records, the most recent incident was Delacuesta's fourth arrest since last July 17, and his third on DUI charges.

On Oct. 10, 2011, Delacuesta was arrested and charged with DUI, speeding and failure to maintain lane. Three months earlier, jail records show he was arrested and charged with DUI, drug possession, open container and failure to maintain lane.

Delacuesta was also arrested in February on shoplifting charges.

He was probably driving on a suspended lisence. This should tell you about our DUI laws. In some European countries they come out and take the plates off your car so that you can not drive your car. The fact that he had a child in car with him puts an innocent person in danger as well as some one who he might hit in an accident. How can you stop someone from driving if they are convicted of DUI, you can not. So figure out how to stop them then DUI will cease to exist.

The question is, has he been sentenced for any of the prior DUIs? If he has, obviously the sentence wasn't enough of a deterrent and it's time for him to sit in jail for quite a while. If he hasn't been sentenced, we need to bring swifter justice to DUI offenders. It's in the best interest of public safety, and in this case, would have been in the best interest of that child.

I doubt he has completed the other cases. It takes a year to a year and a half to go to court in Gwinnett.
