DULUTH — A 6-year-old boy was nearly hit by an errant bullet that whizzed through his bathroom when an enraged Riverdale man opened fire on a Duluth apartment complex, witnesses told police.
Devphn Steward, 24, faces charges of aggravated assault, weapons possession by a convicted felon and second-degree property damage in the Thursday incident. He’s also being held for violating his probation, records show.
Gwinnett police arrested Steward on Sunday evening after staking out a Henderson Mill Road home.
Witnesses at the Landmark at Bella Vista apartments on Club Place told police Thursday that a man arguing with a woman started firing a handgun about 10:30 p.m. before fleeing in a Chrysler 300. Responding officers counted 14 shell casings from a 9 mm gun at the scene.
Officers counted four bullet holes in one apartment. An occupant told police a bullet that tore through the bathroom missed his son by a few feet. A parked Mazda 626 bore two bullet holes, police said.
Minutes later, a woman and her friend called police and claimed they’d been robbed at the same complex, and later shot at, by a stranger. After an interrogation, the complainant admitted to police the alleged robber and shooter was her boyfriend, Steward.
She claimed Steward was upset because she wouldn’t pay him $3,000 she owed him. She told police she had lied to them because she feared for her family.
Police arrested her on obstruction charges, but not before she provided a detailed description of the car Steward drives.
Arresting police found $3,070 and a Glock handgun on Steward, the report states. He remains at the Gwinnett County Jail without bond.
