Occupy Gwinnett targets foreclosure auction

Staff Photo: Josh Green A smattering of protestors associated with Occupy Gwinnett rallied Tuesday morning during a foreclosure auction at the Gwinnett Justice and Administration Center.

LAWRENCEVILLE -- When a snafu with DeKalb County government caused Kenneth Glover to lose his three businesses in the same shopping center -- a liquor store, skating rink and barber shop -- he said it cast him in a financial hole he has yet to emerge from.

His investment capital shot, Glover said his three-bedroom ranch in Snellvlle was next to go, selling in foreclosure last month to Fannie Mae for about $20,000 less than he owed, he said.

Under an ominous canopy of clouds, Glover joined a handful of Occupy Gwinnett supporters Tuesday morning in decrying what they maintain is a heartless and unflinching foreclosure process. The target was a county foreclosure auction at the Gwinnett Justice and Administration Center, a scene crowded with several auctioneers and dozens of bidders. The protestors carried signs scolding banks and a banner reading: "This is a crime scene!"

Sheriff's Deputies kept watch over the proceedings from the courthouse roof and filmed it with handheld cameras. It marked Occupy Gwinnett's first appearance at courthouse auctions, where the group holds regular meetings, leaders said.

"What we have found in the Gwinnett court system is a judge won't look at any paperwork -- they won't listen," said Occupy Gwinnett member Deborah Storm. "In other counties and other states, what we're seeing is, this ain't happening."

One banking industry veteran in the crowd questioned the validity of the protestors' claims -- and the logic behind taking out big loans on unaffordable homes in the first place.

Glover said he's been forced to uproot to Newton County while an appeal he filed lingers in Gwinnett State Court. He feels the foreclosure was executed illegally and claims he was bared from seeing key paperwork before the home was sold.

"I don't feel good (about protesting), but you got to do what you got to do to make people aware," Glover said.

Occupy Gwinnett members have drafted a petition to change the foreclosure laws regarding personal property, insisting that belongings pulled from foreclosed houses should be stored at the expense of the dispossessor. The group first drew attention to their cause early last month, when they picketed a Snellville Wells Fargo Bank and Walmart.

Gwinnett County Sheriff Butch Conway, whose agency executes evictions, has acknowledged the process is unpleasant but has steered clear of meeting with Occupy protestors in an attempt to remain neutral in performing his job, he said. Storm said Tuesday her complaints to the Sheriff's Department have fallen on deaf ears.

Storm said her outcry was aimed at the auction of a woman's home she'd met at Walmart. Last month, she stepped in to assist a Snellville family, the Roreys, that included a DeKalb police officer and who attracted media attention when Occupy Atlanta activists camped in their foreclosed home. That family was evicted Nov. 10.

The Roreys' attorney, Asim Alam, said Tuesday a civil lawsuit challenging Fannie Mae is pending, with depositions scheduled in two weeks.

Supporters say the family had never missed a payment since buying the home in 2003. They intentionally defaulted on a mortgage payment in July 2010 in order to qualify for a loan modification, which they thought would help with rising expenses and their college-age daughter's tuition.

How much nicer our country would be if these stupid "occupy" whatever you call them, would do their thing on the White House lawn. Where were they would this administration and the previous bunch in Congress (2 yrs ago) all voted to give billions to Wall St. It isn't Wall St.'s fault. Wouldn't you have taken all that money if a stupid government gave it to you? Come on folks, you occupy people are a bunch of do-nothing lazy humans who are taking up good space in the world.

1

debbiestorm 2 years, 4 months ago

stupid? kevin, that is totally wrong. none of our occupy gwinnett group is stupid. we are trying to raise awareness of the problem of mortgage fraud, wrongful eviction, and many other issues important to most americans. if anyone got a bailout, it is the banks, not the consumers.

1

Mack711 2 years, 4 months ago

The banks loaned money to people who were not quailified to get the loans in the first place. Many took the loans thinking the economy would be better later when they could afford their purchases. They should have never been approved in the first place. Now that the ecomomy is down and citizens can not pay, the banks will not work with them to save their homes. So they forclose. If you owned a company and no one would buy your prioduct then you close the door. That is what the banks are doing. No they should not be permitted to do this after all the bailouts they have gotten but they refuse to give anyone a break. Can not trust a bank.

Doesn't help that you had Barney Frank blocking any reform to Fannie and Freddie. Those two institutions did a lot of damage to this country.

0

Sthrnldy 2 years, 4 months ago

The foreclosure process is never a suprise to the homeowner. They are given more than enough advance notice to take care of their belongings that are occupying a home that no longer belongs to them!

The vast majority of people that lose their homes to foreclosure should garner no sympathy from the public. It is just one of many failures in a long list of bad decisions that they have made. The Rorey / Occupy publicity stunt was an epic failure because that particular family is the perfect example of the typical foreclosed homeowner.

Occupy the federal government as that is where almost all of our county's problems originate and breed.

1

debbiestorm 2 years, 4 months ago

you forgot, the Rorey's were WRONGFULLY FORECLOSED ON and EVICTED AND THREATENED WITH ARREST BY GWINNETT COUNTY. if you don't have all the facts, don't assume please.

0

Sthrnldy 2 years, 4 months ago

NO - the Rorey's were NOT wrongly foreclosed on and that is why the Occupy ilk abandoned the Rorey family so quickly! As far as being evicted, if they no longer own the home then YES they most certainly were facing being arrested for living in a house that DID NOT BELONG to them!

YOU are the one that does not have her facts straight!

1

debbiestorm 2 years, 4 months ago

You can believe anything you want, but I do have the facts on his case. do you? he also has a pending lawsuit now pertaining to his issue with this house. Unless you were there or you have access to the legal documents..i don't know how you could possibly know the true facts.

0

Sthrnldy 2 years, 4 months ago

You have facts based on what you want to believe. You could have every document sitting in front of you, but I highly doubt you know what you are reading. You should be a better spokesperson for Occupy Gwinnett and have knowledge of what you are getting into. You may win a few fights, but the Rorey's have lost their home for good. In fact, more damage is being done by the negative publcity. You are going to find that the words "I told you so" a very bitter pill to swallow, but knock yourself out. Keep up the good fight, but the Occupy movement is becoming it's own worst enemy.

Why don't all of you "Occupy" folks pool your money and buy all of the foreclosures and just give them back to the people? Oh yeah, I forgot, none of you have JOBS!!!!!!!!!!!!!!!!!!!!!!!!!!

1

debbiestorm 2 years, 4 months ago

why dont you Gundoctor1 ...exercise your rights as an american citizen, if you can't appreciate what we are trying to accomplish, don't worry about it. Not everyone involved in OCCUPY is jobless and the ones that are, do you really believe it is their fault? look at the unemployment rates.

1

debbiestorm 2 years, 4 months ago

Don't Judge too quickly. Too often, people assume too much. Not all "occupiers" are unemployed nor are we LOOKING FOR FREE STUFF. we are just looking to protect our rights as given in the bill of rights. have you not noticed what happened to Scott Olsen? It is not only police brutality, but also a violation of the bill of rights, he was not doing anything wrong. If it's not broke, don't fix it doesn't apply this time, our country is BROKEN beyond belief at this time. Gwinnett County needs to WAKE UP and check out the facts. there are various youtube and news stories that explain this well, what other counties, states, judges, and attorney generals are doing about this problem with banks and mortgage fraud. when you think all its about is people who are unemployed and want things for free, you are not informed. it is certainly not. Did you know that many are homeless in Gwinnett county? I am concerned, are you? Whether you agree on this protest or not, check out the facts about mortgage fraud and bank problems in the USA. We have the right to protest and whether or not you agree, you must know it is legal. and as long as it is legal, there is nothing you can do about it. so why bother to complain.

Anyone who says "why aren't they protesting in Washington?" is either being willfully dishonest, or is uninformed of the facts.

Gwinnett's a real tough crowd, Occupiers. Don't get discouraged.

0

debbiestorm 2 years, 4 months ago

you are so right. Thanks! It is sad the people who just think all judges, sheriffs, banks, lenders, police are always 100% accurate. its just not so.

0

R 2 years, 4 months ago

Folks, How can you support this choice?

"Supporters say the family had never missed a payment since buying the home in 2003. They "intentionally defaulted" on a mortgage payment in July 2010 in order to qualify for a loan modification, which they thought would help with rising expenses and their college-age daughter's tuition."

In this case, they made a "one percent" type INVESTMENT choice. Elsewhere it was reported that no payments were made for a year after the "default" ...

This move was actually fraud - trying to take monies meant to help REAL cases.

.

0

debbiestorm 2 years, 4 months ago

This is not all the facts....there is absolutely no way the reporter had time to get the full story on every aspect of this case.and they were advised to miss a mortgage pymt. by the lender to qualify for a modification. they believed it as most would.

0

MelissaLipnutz 2 years, 4 months ago

The original article indicated an independent loan workout individual recommended the loan default, not the lender. Big difference. They got conned and then caught.

0

debbiestorm 2 years, 4 months ago

R.....take a look around you, this isn't the only family that has been wronged by the Judges in Gwinnett County and many other counties in Georgia..for that matter in the U.S. there are a few select judges that have dug deep to find out the true reason on why the Homeowner has every right to stay in the home and keep it. I suggest some serious reading if you want to know what is really going on. just go to ask.com or google.com and you can certainly find out further info. or you can just believe what you want and assume...in law,,never ever assume.

0

MelissaLipnutz 2 years, 4 months ago

Everything you need to know about a mortgage is right there in the paperwork. Especially under the section titled "Default" or words to the effect. As far as Georgia state law allowing non-judicial foreclosures, that is not the fault of the banks but our legislature.

0

R 2 years, 4 months ago

Sadly we aren't in other areas of the country but right here. I don't have to look around, I'm living this nightmare right here. The folks "chose" to withhold payments they could make, to get a rate change they wanted. That is a questionable loan choice and sets off flags at the get go... As to law advice from Ask.com or Google.com, I'll pass as that recommendation also sets off flags itself. If you are by chance referring to the computerized ownership deed documentation trail or lack thereof, that's another matter all together...

0

NewsReader 2 years, 4 months ago

I just flushed another occupy movement! You people crack me up...especially debbiestorm! LMAO! Wonder if she has the first clue what the difference is between "an inability to pay a mortgage" versus "a conscious decision not to pay a mortgage". Anyone? Anyone? Bueller?

news reader..crack up if you like. WWJD. sorry Newsreader, you are not totally informed and making a wise decision in being so critical. sometimes the one who u think knows nothing, will be the one to laugh last. 0

debbiestorm 2 years, 4 months ago

to all those readers who are thinking OCCUPY GWINNETT is a bad thing, take a look around, if you have a warm place to sleep tonite and food, you are doing well. There are homeless people in GWINNETT among other areas across the U.S. I happen to be concerned with that. Also concerned about all of the homeowners facing any issue with losing their home, apt, home rental, etc. This is nothing to laugh at. While some of you are out Christmas shopping, I am out helping people for no other reason than to do what I was called to do. I have no desire to Christmas shop when so many are suffering. It is tragic that so many are so judgemental, especially the ones who call themselves Christians. Didn't Jesus look out for the lost sheep and the poor?

0

Sthrnldy 2 years, 4 months ago

Please STOP lecturing the majority as they (we) simply do not agree with you and the Occupy folks across this country.

You say that you are concerned about the homeless, which is fine. However, Occupy is about destroying the wealth of the so-called 1%. Isn't that your message? Please do not come on here and continue your finger pointing when your message is loosing ground and misguided.

Occupy DOES NOT SPEAK for the overwhelming majority of Americans. Good for you that you are helping out others. However, there are many other people that are charitable and philanthropic but don't feel the need to brag or boast about their giving. You are certainly not acting very Christian yourself!

0

debbiestorm 2 years, 4 months ago

No one is bragging, sorry, your 1% does not outnumber the 99%. finger pointning? since when did telling about Jesus become finger pointing? seems like i have every right to post what i do becuz of the bill of rights. same as you. unless you can change that law, please don't tell me what i should post.

0

SomeLady, that is so RUDE. You can say what you will, but if you really think you are hurting me, you are actually hurting yourself. You are not hurting me. I am not the judge. Only God can judge. In my world, I cannot turn my back on those in need. maybe in yours you can. its all about decisions.

What? I am agreeing with you! I was being ironic. I posted this comment a few days ago and it appeared, but now it's mysteriously gone so I'll try again!

0

Sthrnldy 2 years, 4 months ago

What debbiestorm fails to recognize is that the Rorey's were the ones guilty of mortgage fraud. My question is what did they do with all that money from a year's worth of missed mortgage payments? Did they even attempt to pay that money to the financial insitutional that held their mortgage? A LEO should know how to access state and federally licensed mortgage lenders are before getting involved with them, he could have reported them and shut them down if they were true crooks. Case closed, except for the fact the Rorey's will pay dearly for their financial disaster and a failed publicity stunt.

If you search the Internet for LEO Rorey you will find that he is a little less than upstanding at his professional career.

The Occupy movement is steadily loosing credibility, not that they had much to begin with. The really are their own worst enemies

0

debbiestorm 2 years, 3 months ago

they are not guilty of mortgage fraud. You have no clue what you are talking about. They have an attorney handling their case. Their case is still before the courts whether you know it or not...and thank goodness you are not the judge, as i am sure you would judge everyone guilty, everytime you read anything.

The mess we're in is a direct result of federal elected members of Congress actively conspiring through FNMA and FHMC and direct lenders/mortgage brokers to boost economic growth to an unsustainable level...then the bubble burst and I don't think we are near the bottom yet. We got an advance on our economy and now we're paying for it. Some are paying more than others.

As long as the OWS folks fail to grasp the enormity of the problem they will have no effect. It's not about democrat and republican anymore...this mess transcends politics and it may take five or ten more years to recover. Millions of jobs that really weren't needed in the first place simply disappeared starting in late '08 and they're not coming back. Get used to it.

"Millions of jobs that really weren't needed in the first place simply disappeared starting in late '08 and they're not coming back. Get used to it."

I don't know about jobs not needed, but I believe they were transitioned to other countries... And they may not come back as long as Washington keeps us at a artificial disadvantage.

TO ALL the critical folks out there...the LENDER has stopped the eviction after an appeal was filed...so hows that for you people who always blame the borrower? now whatcha think? u think the lender did this becuz they are stupid? LOL (pertaining to the Kenneth Glover case)

0

Sthrnldy 2 years, 3 months ago

It is well known, widespead FACT that all lenders, including Fannie & Freddie have put a stop on evictions and foreclosures during the Holidays.

Bless your heart! Merry CHRISTmas!

0

debbiestorm 2 years, 3 months ago

It is a well known fact that the eviction on Kenneth Glover already happened. this was actually on the appeal action, the appeal court date was pending. Due to obviously the facts in the case, the "lender" or plaintiff in the case withdrew the action of eviction, which tells me that they know they don't have the proper paperwork as I knew prior to the judge's decision. So from my standpoint, The Judge did make a huge error. this has nothing to do with stopping evictions and foreclosures for the holidays...the court date could have been as far a year away. Good Lord. Yall can't wait to crucify someone can u?

0

Sthrnldy 2 years, 3 months ago

Glover has used this home as a rental. He also has stated that he lives in another city and county now. Legal public notices not hard to find. Glover has been in the foreclosure process for a while as shown in the GDP legals section. The appeals process is just that. The fact that evictions and foreclosures are on a Holiday moratorium means you might have wasted your time. Everything is fair game come January 2012.

What legal credentials do you have? Are you relying on your past "experiences" with the legal system?

0

debbiestorm 2 years, 3 months ago

u are so nosey it aint funny. it is not a rental. his child lives there with a family of his. so there u have it nosey lady. legal credentials? im a certified paralegal. one of my teachers was Judge Carla Brown.

Your 1st post ... "the LENDER has stopped the eviction"

Your 2nd post (reply)..."It is a well known fact that the eviction on Kenneth Glover already happened. this was actually on the appeal action, the appeal court date was pending."

MAKE UP YOUR MIND! You are CONSISTENTLY contradicting yourself! It is not hard to "crucify" someone that has no clue what they are posting and seems to be making up whatever as they go along. You make it easy LOL!

Please, go back and re-read everything you post. You are damaging your own credibility and intelligence at every turn. You really are your own worst enemy!

0

debbiestorm 2 years, 3 months ago

read further...you love to try and prove a point without knowing all the fine details. dontcha? there was an eviction hearing already, then an eviction appeal for the Glovers. The appeal was stopped before it was ever heard in court. how many times do you need reminded?

i really suggest that you stop trying to belittle me. thanks

Glover said he's been forced to uproot to Newton County

Forced to uproot! Must be extremely devastating to lose a home in Gwinnett and be forced to move to Newton County. Has Occupy been invited to visit Mr. Glover at his home in Covington?

1

debbiestorm 2 years, 3 months ago

since when is that anyones business? do you think i care what visitors you have at your home? and why does it concern you Where Glover lives?

0

debbiestorm 2 years, 3 months ago

to sthrnldy: guess what? the appeal withdrawal was not done until late dec. 2011. so of course things were different prior to that date...damage my creditiablity? are you kidding? you think you have all the answers but yet i was there with Kenneth Glover in court. and I had the knowledge that the case had been withdrawn by the lender. So what are you talking about? i have in no way damaged by creditibility, I think the Judge has. When you stop and think that the Lender backed off and decided to not go thru with an appeal after a decision had been already made in the lender's favor. If you don't have a legal education and are interested in learning, i suggest you do some reading instead of accusing me of damaging my creditibility.....and to the "get used to it" commit by Melissa...get used to it..banks are abusing their authority! that is exactly why this case was dropped by the lender..they know they cannot win on the appeal...more evidence in their favor would be required which they do not have. DONT JUDGE SO QUICKLY. The only Judge is GOD he saw it all.

0

sure sounds like a "witch hunt" to me...not very neighborly like. too bad people haven't learned from love thy neighbor as thyself.

0

Sthrnldy 2 years, 3 months ago

LMAO at the term "witch hunt". In a matter of minutes the internet can provide any citizen with all sorts of valuable infomation. It is even easier in GA and Gwinnett where many records are on display for public consumption. Believe it or not, I have been very selective in revealing the vast amount of information I have uncovered (in a very small amount of time!).

You people are what they call limited purpose public figures, folks who have thrown themselves into public controversies in order to influence the outcome of the issues involved. By voluntarily throwing yourselves into such controversies, limited purpose public figures invite attention onto themselves.

When you lecture from the bully pulpit you basically invite scrutiny. So keep posting misinformation and half truths if you wish. Can't wait to see what you come up with next.

Wasn't it brutally cold out today? A wolf should not dress in sheep's clothing! :)

1

Sthrnldy 2 years, 3 months ago

"since when is that anyones business? do you think i care what visitors you have at your home? and why does it concern you Where Glover lives?"

Regarding Glover's primary residence, it most certainly is the public's business when you try and deceive people that he and his family were suddenly evicted from his "home" in Gwinnett. He owns a home in Newton County and lost his rental property in Gwinnett, isn't that a more accurate assessment of what is going on here? Did you even know that?

Stop acting like a heroine that is out to save the poor and defenseless from loosing their homes. These people are the part of the problem. You are part of the problem when you try and help people that have cheated the system and LOST.

1

debbiestorm 2 years, 3 months ago

you do not even have a clue to the truth. and so please explain further, are u an official who needs to know the private life of Kenneth Glover? i don't think its anyones business unless u are a govt. official like the police and even they don't care what he is doing unless it is illegal. I am not a part of the problem, I am a part of the solution, as Kenneth's home has been SAVED. Of course it was cold out at the Jan. foreclosure protest, but worth every brutal moment becuz of the cause.

0

Sthrnldy 2 years, 3 months ago

Bless your heart, debbiestorm! It is painfully obvious that my knowledge and resources are getting the best of you. I see you are having trouble, once again, wrapping your little brain around anything that makes sense or is factual.

Glover does not own property in Gwinnett. The property you keep claiming you SAVED is actually listed as being OWNed by the Federal National Mortgage Association / aka Fannie Mae ;) I suggest you have a "come to Jesus" meeting with Glover. You may think you are winning a few legal battles, but I can promise you will not win the war. It is safe to say you might suffer from some sort of post tramatic stress once Occupy is finally dead.

On another note, I will admit that you actually might be part of "the solution" afterall! I have strong faith and a firm belief that the "powers that be" are using the failures of Occupy to protect the good and decent citizens of this country from the likes of the entitlement class (aka Glover, Rorey, Storm). Thank You in advance for the sacrifices you have made for me and my family!!!

Finally, this constant need of knowledge and appoval from me that you have really must end! I have learned another valuable lesson in my dealings with you: Don't feed stray animals!

GOD Bless you debbiestorm! Happy 2012!

debbiestorm 2 years, 3 months ago

My gosh Sth......u are once again trying to be extremely rude. Since u are not involved in Occupy, how in the world do u know so much about it? and btw I already have PTSD for many years, for your info...although it has nothing to do with anything and really not ur business..i volunteered that info. Occupy will never die btw. What is don't feed stray animals? sorry I am a big supporter of Georgia Equine Rescue League as well as the Humane Society. I don't have a little brain, thanks for your insults though, they make me see what a rude individual u are. How could anyone be so ugly?
