DULUTH (AP) — The family of a man killed in a head-on collision a year ago is suing the Duluth restaurant that served alcohol to the two men now facing charges in his death.
The lawsuit alleges that Cafe Todahmgol "knew or should have known" that 22-year-old Soon Kwon and 23-year-old Gho H. Lee would soon be driving. Authorities say the two had left the restaurant in separate cars when Kwon sideswiped the car driven by Lee and then veered into oncoming traffic, hitting Eddie Ko's car head-on.
Ko died later at a hospital. A passenger in Kwon's car, 22-year-old Se Shin, also died.
Kwon is charged with vehicular homicide, DUI and other charges. Lee is charged with DUI and other charges.
A woman who said she was the restaurant's manager declined comment.
