Lawrenceville man charged with molesting 5-year-old

LAWRENCEVILLE -- A Lawrenceville man is behind bars after police said he performed oral sex on a 5-year-old female relative.

David Lee Whitacre, who turns 20 on Monday, was arrested Saturday and charged with aggravated child molestation by sodomy.

The suspect and alleged victim do not share the same last name, police said. The Gwinnett Daily Post does not identify victims in sexual assault cases.

According to reports, the incident took place sometime between morning and late afternoon Friday at a Lawrenceville residence.

"The victim made an outcry of sexual contact against the suspect to her mother," said Gwinnett police spokesman Cpl. David Schiralli. "We responded and investigated/interviewed Mr. Whitacre, after which we had enough probable cause to arrest him."

Under Georgia law, a conviction for aggravated child molestation carries a penalty of 25 years to life in prison.

Whitacre, who has no prior arrests in Gwinnett, is being held at the Gwinnett County Jail without bond.

A probable cause hearing has been scheduled for Thursday afternoon.
