ZONING CASES - ON THE AGENDA: Here's a look at the actions taken on rezonings and other requests made of the Gwinnett County Board of Commissioners at its Tuesday meeting.
1. Tabled until March. 24: Applicant requests construction of a 195-foot telecommunication tower with ground equipment at 2050 Hurricane Shoals Road. Staff recommendation is approval with conditions. TSP-2008-00023 2. Tabled until March 24: Applicant requests construction of a 199-foot telecommunication tower with ground equipment at 2565 Camp Mitchell Road. Staff recommendation is approval with conditions. TSP-2008-00024 3. Tabled until Feb. 24: Applicant requests construction of a 155-foot monopole telecommunication tower with ground equipment at 2443 Collins Hill Road. Staff recommendation is approval with conditions. TSP-2008-00027 4. Denied: A requested special-use permit in a general-business district to allow an outdoor soccer field as part of a retail development and indoor soccer complex on 4.9 acres. The property is located at the 4300 block of Buford Highway across from South Old Peachtree Road. The planning department and planning commission recommended denial. SUP-08-065 5. Tabled until Feb. 24: A requested special-use permit in a general-business district to allow for a 3,000-square-foot, full service car wash on 7.24 acres. The property is located at the 3600 block of Centerville Highway and the intersection with the 3600 block of Campbell Road. The planning department and planning commission recommended approval with conditions. SUP-08-089 6. Denied without prejudice: Applicant requests a rezoning and a special-use permit from a single-family residence district (R-100) to an office-institutional district (O-I) to allow for a 10,000-square-foot daycare center on 2.55 acres. The property is located at the 1000-1100 block of Rock Springs Road and the 1000 block of Laurel Drive. The planning department has recommended approval with conditions and the planning commission recommended deny without prejudice. RZC-08-087 and SUP-08-082 7. Denied: A requested rezoning in a single-family residence district (R-75) to an agricultural-residence district (RA-200) and an accompanying special-use permit to allow an existing church to add a cemetery on 11 acres. The property is located at the 600 block of Dickens Road. The planning department and planning commission recommended denial. RZC-08-005 and SUP-08-096 8. Approved with conditions: Applicant requests to change the conditions to reduce the required landscape strip and buffer for a previously-issued rezoning and special-use permit for a 1,471-square-foot automobile sale business located in a general business district (C-2). The property is part of a 1.13-acre parcel and is located at the 2200 block of Lawrenceville Highway. The planning department and planning commission recommended approval with conditions. CIC-09-001 9. Approved with conditions: Applicant requests to change the conditions of a previous rezoning in a neighborhood-business district (C-1) for a 5,120-square-foot convenience store with separate leasable tenant space located on 1.72 acres. The property is located at the 1300-1400 blocks of Harbins Road and the 5600 block of Singleton Road. The planning department and planning commission recommended approval with conditions. CIC-09-002 10. Approved with conditions: Applicant requests to change the conditions of a previously-issued special-use permit in a single-family residence district (R-100) to allow for a before and after school program and to increase the number of students at the private school associated with St. John Neumann Church. The property is located on 19.74 acres and is located at the 700-800 blocks of Tom Smith Road. The planning department and planning commission recommended approval with conditions. CIC-09-004 11. Approved with conditions: Applicant requests to change the conditions of a previous rezoning to allow for direct access to Duluth Highway. The property resides in a light industry district (M-1), is located on 1.10 acres and is located at the 1600 block of Duluth Highway and the 1700 block of Spectrum Drive. The planning department and planning commission recommended approval with conditions. CIC-09-005 12. Approved with conditions: Applicant requests to change the conditions of a previously-issued special-use permit to allow for an additional monument ground sign. The property resides in a general-business district (C-2), is located on 2.18 acres and is located at the 3500 block of Breckinridge Boulevard. The planning department and planning commission recommended approval with conditions. CIC-09-006 13. Approved with conditions: Applicant requests the renewal of a special-use permit for a 9.05-acre tract of land zoned general-business district (C-2) and office-institutional district (O-I) to allow for the continued use of an outdoor soccer field. The property is located at the 6100 block of Live Oak Parkway and the 1500-1600 block of Thompson Parkway. The planning department and the planning commission recommended approval with conditions. SUP-09-005 14. Tabled until Feb. 24: Applicant requests a special-use permit for a 5.28-acre parcel zoned heavy-industry district (M-2) to allow for the development of a solid waste transfer station. The property is located at the 100 block of Alcovy Industrial Boulevard. The planning department has recommended approval with conditions. The planning commission tabled the case until its Feb. 17 meeting. SUP-09-007 15. Tabled until Feb. 3: Applicant requests a special-use permit for a 5.92-acre parcel zoned general-business district (C-2) to allow for the development of a mini-warehouse and climate-controlled self-storage facility. The property is located at the 3400 block of Sugarloaf Parkway. The planning department recommended denial. The planning commission recommended approval with conditions. SUP-09-008 16. Tabled until Feb. 24: Applicant requests the renewal of a special-use permit for a 0.58-acre tract zoned general-business district (C-2) to allow for the continued use of an automobile service center. The property is located at the 500 block of Braselton Highway. The planning department recommended denial. The planning commission recommended approval with conditions. SUP-09-009 17. Tabled until Feb. 24: Applicant requests a special-use permit for a 1.47-acre parcel zoned general-business district (C-2) to allow for a 2,500-square-foot, self-service coin operated laundromat. The property is located at the 6400 block of Peachtree Industrial Boulevard and the 6900 block of Jimmy Carter Boulevard. The planning department recommended approval with conditions. The planning commission tabled the case until its Feb. 17 meeting. SUP-09-010 18. Approved with conditions: Applicant requests a special-use permit for a 0.40-acre parcel zoned general-business district (C-2) to allow for a 1,350-square-foot, self-service coin operated laundromat. The property is located at the 3200 block of Peachtree Corners Circle. The planning department and planning commission recommended approval with conditions. SUP-09-011 19. Tabled until Feb. 24: Applicant requests a rezoning from a multi-family residence district (RM-6) to a general-business district (C-2) to allow for a 51,800-square-foot commercial retail facility on 9.54 acres that would constitute an expansion of the Webb Gin Crossings retail development. The property is located at the 1100 block of Scenic Highway. The planning department recommended approval with conditions. The planning commission tabled the case until its Feb. 17 meeting. RZC-09-001 20. Rezoning tabled until Feb. 3, SUP denied without prejudice: Applicant requests a rezoning and special-use permit from an office and institutional district (O-I) to a general-business district (C-2) to allow for a 115,100-square-foot retail center consisting of a restaurant and two, four-story hotels, on 10.26 acres. The property is located at the 2400-2500 blocks of Buford Drive. The planning department recommended denial. The planning commission recommended approval with conditions on the rezoning and deny without prejudice on the SUP. RZC-09-005 and SUP-09-003 21. Approved with conditions: Applicant requests a rezoning and special-use permit from a single-family residence district (R-100) to a light-industry district (M-1) on 25.83 acres to allow for the development of a mini-warehouse storage facility with outdoor storage capability that would permit boat and RV parking. The property is located at the 6000 block of Loganville Highway. The planning department and planning commission recommended approval with conditions. RZC-09-006 and SUP-09-004 22. Denied: Applicant requests a rezoning from an office and institutional district (O-I) to a neighborhood-business district (C-1) to allow for a commercial/retail use in a recently converted 1,392-square-foot residential structure located on 0.42 acres. The property is located at the 1400 block of Scenic Highway. The planning department and planning commission recommended denial. RZC-09-007 23. Denied: Applicant requests a rezoning and a special-use permit from a single-family residence district (R-75) to a general-business district (C-2) to allow for a 1,972-square-foot contractor's office with outdoor storage to be located on 1.18 acres. The property is located at the 100 block of Gloster Road and the 0-100 block of Jordan Drive. The planning department and planning commission recommended denial. RZC-09-008 and SUP-09-006 24. Approved with conditions: Applicant requests a rezoning from a single-family residence district (R-100) to a general-business district (C-2) to allow for the development of a two-story, 12,900-square-foot commercial retail center to be located on 0.60 acres. The property is located at the 1200 block of Old Peachtree Road. The planning department and planning commission recommended approval with conditions. RZC-09-009 25. Denied: Applicant requests a rezoning from a single-family residence district (R-100) to a neighborhood-business district (C-1) to allow for a 1,600-square-foot daycare center to be located on 1.14 acres. The property is located at the 3100 block of Bethany Church Road. The planning department and planning commission recommended denial. RZC-09-010 26. Approved with conditions: Applicant requests a rezoning from a single-family residence district (R-100) to a general-business district (C-2) to allow for a 14,088-square-foot building contractor's office to be located on 0.85 acres. The property is located at the 2000 block of Puckett's Drive and the 5000 block of Parker-Pucketts Way. The planning department and planning commission recommended approval with conditions. RZC-09-011 27. Tabled until Feb. 3: Being reconsidered by consent order, the applicant requests a rezoning from a single-family residence district (R-100) to a multi-family residence district (RM-13) to allow for the development of a 378 unit/15 building apartment complex to be located on 29.72 acres. The property is located at the 900-1200 blocks of Satellite Boulevard. The planning department recommended denial. The planning commission recommended approval with conditions.
