Under and by virtue of O.C.G.A. § 44-3-232, the Declaration of Covenants, Conditions and Restrictions for The Village at Albion Farm, as may be amended (the "Declaration"), filed of record in the Gwinnett County, Georgia records, and by virtue of the Court Order dated November 18, 2008 as well as obedience to the Writ of Fieri Facias in the above styled case with a judgment date of October 15, 2008, there will be sold by the Sheriff of Gwinnett County at public outcry to the highest and best bidder for cash on the walkway in front of the Gwinnett County Justice and Administration Center (GJAC), 75 Langley Dr., Lawrenceville, Gwinnett County, Georgia 30045 within the legal hours of sale on the first Tuesday in May, to wit, May 5, 2009, the following described property:

ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 244 OF THE 7TH DISTRICT, GWINNETT COUNTY, GEORGIA, BEING LOT 19 OF THE VILLAGE AT ALBION FARM SUBDIVISION, UNIT 1, AS PER PLAT RECORDED IN PLAT BOOK 56, PAGE 226, GWINNETT COUNTY, GEORGIA RECORDS, WHICH PLAT IS REFERRED TO AND INCORPORATED HEREIN BY REFERENCE.

The debt secured by the Association's lien, which totals $10,281.43 as of February 4, 2009, has been and is hereby declared due because of failure to pay the indebtedness as and when due and in the manner provided for in the Declaration. The debt remaining in default, this sale will be made for the purpose of paying same and all expenses of the sale, as provided in the Georgia Property Owners Association Act, O.C.G.A. § 44-3-220, et seq., and the Declaration (notice of attempt to collect attorney's fees having been given). The excess, if any, will be distributed to the person or persons legally entitled thereto.

To the best knowledge and belief of the undersigned, the party(ies) in possession of the Subject Property known as 3080 Barnwood Crossing Duluth GA 30097 is Terrie R. Miller.

Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, (c) the Declaration, as amended, and (d) all matters of record superior to the condominium lien first set out above, including but not limited to the Security Deed from Terrie R. Miller to Century Mortgage Corporation, recorded at Deed Book 27086, Page 102 of the aforesaid records, and any encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the condominium lien first set out above.

The sale will be conducted subject to confirmation that the sale is not prohibited under the United States Bankruptcy Code.

Said property having been found to be in the possession of the defendant, Berkley Lake Partners, LLC, and levied upon as the property of the defendant in accordance with the Writ of Fieri Facias stated above. Levy made by Major David Parr, SO32 on December 2, 2008.

The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record, which may affect said property.
