NOTICE OF BOND ELECTION TO THE QUALIFIED VOTERS OF THE CITY OF BUFORD: NOTICE IS HEREBY GIVEN that on February 5, 2008, an election will be held at the regular and established polling places in all the election precincts of the City of Buford at which time there will be submitted to the qualified voters of the City of Buford for their determination the question of whether or not general obligation bonds in the aggregate principal amount of $10,000,000 shall be issued by the City of Buford for the purpose of acquiring, constructing, and equipping additional city facilities, including a multi-purpose facility to house and in furtherance of the following: (i) recreation and athletics, (ii) fine arts, (iii) education, (iv) community-wide and campus-wide events and programs, and (v) administrative offices, and other buildings and facilities useful in connection therewith, acquiring property, real and personal, necessary therefore, and paying expenses incident thereto. The bonds, if so authorized, shall be dated either the first day of the month during which the bonds are actually issued and delivered or the first day of the month immediately preceding the month during which the bonds are actually issued and delivered, shall be in the denomination of $5,000 each or integral multiples thereof, shall be numbered from R-1 upwards in accordance with their issuance as shown by the registration books kept with respect to such bonds, shall bear interest payable January 1, 2009, and payable annually thereafter on January 1 in each year, at an interest rate or rates not to exceed 5% per annum, until paid, subject to redemption at the option of the City prior to their respective maturities upon the terms and conditions to be determined by the Commission, and maturing on January 1 in the years and amounts, as follows: Year; Amount 2014 $666,666.66 2015 666,666.66 2016 666,666.66 2017 666,666.66 2018 666,666.66 2019 666,666.66 2020 666,666.66 2021 666,666.66 2022 666,666.66 2023 666,666.66 2024 666,666.66 2025 666,666.66 2026 666,666.66 2027 666,666.66 2028 666,666.76 The bonds may be made subject to redemption at the option of the City of Buford prior to their respective maturities upon the terms and conditions to be determined by the City Commission of the City of Buford. The ballots to be used at the election shall have written or printed thereon substantially the following: ___YES ___NO "Shall General Obligation Bonds in the amount of $10,000,000 be issued by the City of Buford for the purpose of acquiring, constructing, and equipping additional city facilities, including a multi-purpose facility to house and in furtherance of the following: (i) recreation and athletics, (ii) fine arts, (iii) education, (iv) community-wide and campus-wide events and programs, and (v) administrative offices, and other buildings and facilities useful in connection therewith, acquiring property, real and personal, necessary therefore, and paying expenses incident thereto?" The several places for holding said election shall be at the regular and established voting precincts of the election districts of the City of Buford, and the polls will be open from 7:00 a.m. to 7:00 p.m. on the date fixed for the election. Pursuant to O.C.G.A. Section 21-2-224(a) and (b)(1), since the election is held in conjunction with a presidential preference primary, the registration deadline for such election shall be the close of business on the fifth Monday or, if such Monday is a legal holiday, by the close of business on the following business day prior to the date of such election: to wit, January 7, 2008. In accordance with O.C.G.A. Section 36-82-1(d), as amended, any brochures, listings, or other advertisements issued by the City or by any other person, firm, corporation or association with the knowledge and consent of City shall be deemed to be a statement of intention of said City concerning the use of the proceeds of the bonds and shall be binding on the City in the expenditure of any such bond proceeds or interest received from such bond proceeds which have been invested, unless the City uses such bond proceeds for the retirement of bonded indebtedness, in the manner provided for in O.C.G.A. Section 36-82-1(d). Those residents of the City of Buford qualified to vote in the election shall be determined in all respects in accordance with the election laws of the State of Georgia.
