NOTICE OF ELECTION
TO THE QUALIFIED VOTERS OF GWINNETT COUNTY, GEORGIA IN WHICH THE GWINNETT SCHOOL DISTRICT IS LOCATED: NOTICE IS HEREBY GIVEN that on the 5th day of February, 2008, an election will be held at the regular polling places in all the election districts of Gwinnett County, Georgia, in which the Gwinnett County School District is located at which time there will be submitted to the qualified voters of Gwinnett County in which the Gwinnett County School District is located for their determination the question of whether general obligation debt of the Gwinnett School District in the principal amount of not to exceed $750,000,000 (the "Gwinnett Bonds") should be issued, the proceeds of which are to be used and applied for projects for educational purposes of the Gwinnett County School District (the "Gwinnett School District") and for the payment of interest on such Gwinnett Bonds for a period of not more than 18 months from the date of issuance thereof and costs of issuance of such Gwinnett Bonds as described below. The projects of the Gwinnett County School District to be funded in whole or in part by the proceeds of the Gwinnett Bonds in accordance with the established priorities in its five-year building and technology program are as follows (collectively, the "Gwinnett Projects"): (a) acquiring new sites for the construction of new schools, support facilities and athletic facilities and the expansion of existing schools and support facilities; (b) developing sites for constructing and equipping new schools, support facilities and athletic facilities specifically including, but not limited to, the following: (i) Central Cluster Elementary School, (ii) Peachtree Ridge Cluster Elementary School #1, (iii) Berkmar/Meadowcreek Area Elementary School, (iv) North Cluster Elementary School, (v) South Cluster Middle School, (vi) Shiloh Cluster Elementary School, (vii) Math/Science High School, (viii) Central Cluster Middle School #1; (c) making additions to and/or renovating, equipping modernizing and upgrading excisting schools, support facilities and athletic facilities specifically including, but not limited to, the following: (i) Radloff Middle School, (ii) Shiloh High School, (iii) Shiloh Middle School, (iv) Meadowcreek High School, (v) Sugar Hill Elementary School, (vi) Alcova Elementary School, (vii) Central Gwinnett High School, (viii) Parsons Elementary School, (ix) Chesney Elementary School, (x) South Gwinnett High School (x) District-Wide Support Facilities; and (d) modernizing technology and making system-wide technology improvements. The Gwinnett Bonds, if so authorized, may be issued by the Gwinnett County School District from time to time in whole or in part and in one or more series. The Gwinnett Bonds shall be dated their date of issuance, or, at the option of the Board of Education of the Gwinnett County School District (the "Gwinnett Board"), on the first day of any month thereafter prior to the date of issuance of the Gwinnett Bonds, shall bear interest from such date, payable semiannually on the first days of February and August in each year, commencing August 1, 2008, or the first February 1 or August 1 following the date of issuance of each such series of the Gwinnett Bonds, at an interest rate or rates not to exceed 5.50% per annum (the exact interest rates to be determined by supplemental resolution of the Gwinnett Board prior to the issuance of the Gwinnett Bonds), until paid, and shall mature (serially or, at the option of the Gwinnett Board, by mandatory sinking fund redemption) on the first day of February in the years and amounts, as follows: Date ; Maximum Principal Payable in Such Year 2009; $0 2010; 0 2011; 0 2012; 0 2013; 0 2014; 2,500,000 2015; 5,500,000 2016; 12,500,000 2017; 17,500,000 2018; 19,800,000 2019; 23,500,000 2020; 25,590,000 2021; 26,905,000 2022; 28,280,000 2023; 29,735,000 2024; 31,255,000 2025; 32,860,000 2026; 34,545,000 2027; 36,315,000 2028; 38,180,000 2029; 40,135,000 2030; 42,195,000 2031; 44,360,000 2032; 46,635,000 2033; 49,025,000 2034; 51,540,000 2035; 54,185,000 2036; 56,960,000 Total $750,000,000 The maximum annual debt service on the Gwinnett Bonds in any year shall not exceed $61,644,775. Any brochures, listings or other advertisements issued by the Gwinnett Board or by any other person, firm, corporation or association with the knowledge and consent of the Gwinnett Board, shall be deemed to be a statement of intention of the Gwinnett Board concerning the use of the proceeds of the Gwinnett Bonds. YOU ARE FURTHER NOTIFIED that the Gwinnett School District will not conduct any performance audit or performance review with respect to the Gwinnett Bonds as such terms are described in O.C.G.A. Section 36-82-100. Voters desiring to vote for the issuance of the Gwinnett Bonds shall do so by voting "YES" and voters desiring to vote against the issuance of the Gwinnett Bonds shall do so by voting "NO" as to the question propounded below. The ballots to be used at such election shall have written or printed thereon substantially the following: YES; NO Shall general obligation debt of the Gwinnett County School District in the principal amount of not to exceed $750,000,000 be issued for the purpose of funding (i) all or a portion of the following projects for Gwinnett County School District (A) acquiring new sites for the construction of new schools, support facilities and athletic facilities and the expansion of existing schools and support facilities; (B) developing sites and constructing and equipping new schools, support facilities and athletic facilities; (C) making additions to, renovating, upgrading and equipping existing schools, support facilities and athletic facilities; and (D) modernizing technology and making system-wide technology improvements (collectively, the "Gwinnett Projects"); (ii) all or a portion of the interest on such general obligation debt for a period of not more that 18 months from the date of issuance of such general obligation debt; and (iii) paying costs of issuance of such general obligation debt? The several places for holding such election shall be at the regular and established voting precincts of the election districts of Gwinnett County, Georgia, in which the Gwinnett County School District is located and the polls will be open from 7:00 a.m. to 7:00 p.m. on the date fixed for the election. The last day to register to vote in this election shall be January 7, 2008, through midnight. All residents of Gwinnett County in which the Gwinnett County School District is located which are qualified to vote at such election shall be determined in all respects in accordance with the election laws of the State of Georgia. Section 36-82-1(d), as amended, any brochures, listings, or other advertisements issued by the City or by any other person, firm, corporation or association with the knowledge and consent of City shall be deemed to be a statement of intention of said City concerning the use of the proceeds of the bonds and shall be binding on the City in the expenditure of any such bond proceeds or interest received from such bond proceeds which have been invested, unless the City uses such bond proceeds for the retirement of bonded indebtedness, in the manner provided for in O.C.G.A. BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA SECTION 1. The City of Lawrenceville shall be and is authorized to exercise all redevelopment and other powers under Chapter 44 of Title 36 of the O.C.G.A., the "Redevelopment Powers Law," as amended. The intention of this Act is to authorize the City of Lawrenceville to undertake and carry out community redevelopment, to create tax allocation districts, to issue tax allocation bonds, and to incur other obligations within the meaning of and as fully permitted under the provisions of Article IX, Section II, Paragraph VII(b) of the Constitution of the State of Georgia of 1983, as amended, and to authorize the City of Lawrenceville to exercise redevelopment powers as fully as the "Redevelopment Powers Law" may now or hereafter permit and not to limit any redevelopment powers permitted under the "Redevelopment Powers Law." SECTION 2. Unless prohibited by the federal Voting Rights Act of 1965, as amended, the municipal election superintendent of the City of Lawrenceville shall call and conduct an election as provided in this section for the purpose of submitting this Act to the electors of the City of Lawrenceville for approval or rejection. The municipal election superintendent shall conduct that election on any permissible referendum date not later than the November, 2008, state-wide general election and shall issue the call and conduct that election as provided by general law. The municipal election superintendent shall cause the date and purpose of the election to be published once a week for two weeks immediately preceding the date thereof in the official organ of Gwinnett County. The ballot shall have written or printed thereon the words: "( ) YES ( ) NO Shall the Act be approved which authorizes the City of Lawrenceville to exercise redevelopment powers under the 'Redevelopment Powers Law,' as it may be amended from time to time, for the purpose of improving economic and social conditions in depressed areas within the city?" All persons desiring to vote for approval of the Act shall vote "Yes," and all persons desiring to vote for rejection of the Act shall vote "No." If more than one-half of the votes cast on such question are for approval of the Act, then Section 1 of this Act shall become of full force and effect immediately. If Section 1 of this Act is not so approved or if the election is not conducted as provided in this section, Section 1 of this Act shall not become effective and this Act shall be automatically repealed on the first day of January immediately following that election date. The expense of such election shall be borne by the City of Lawrenceville. It shall be the election superintendent's duty to certify the result thereof to the Secretary of State. SECTION 3. Except as otherwise provided in Section 2 of this Act, this Act shall become effective upon its approval by the Governor or upon its becoming law without such approval. SECTION 4.
