Pursuant to the Writ of Fieri Facias entered by the State Court of Gwinnett County, Georgia on August 21, 2008, Civil Action No. 08-C-04955-S3 and in favor of Excel Federal Credit Union, Plaintiff and against Berkeley Lake Partners., LLC, Donald C. Hartsfield, Neil Lansing and Fortis Holdings, Inc, defendants, the below described property will be sold at public auction to the highest and best bidder for cash, between the legal hours of sale before the courthouse doors at the Gwinnett Justice and Administration Building (GJAC), 75 Langley Dr., Lawrenceville, Gwinnett County, Georgia, on the first Tuesday in January, 2009 to wit: January 6, 2009.

Each lot described below will be sold as a separate and distinct parcel of land. None of the three (3) lots being offered for sale as described below have any buildings located on the land.

Lot 1

ALL THAT TRACT OR PARCEL OF LAND lying and being in Land Lot 290 of the 6th Land District, Gwinnett County, Georgia, being described as Future Building 3341 on Tract B on that certain Final Plat for Berkeley Lake Village, said plat being recorded on July 27, 2007 in Plat Book 121, Page 35, Gwinnett County, Georgia Records, said future building being further described as follows:

BEGINNING at a point at the intersection of the Land Lot Line common to Land Lots 267 and 290 and the easterly margin of the right of way of Peachtree Industrial Boulevard (revised right of way with varying width); thence North 39 degrees 51 minutes 19 seconds East a distance of 654.51 feet to a point, said point being the TRUE PLACE OR POINT OF BEGINNING.

FROM THE TRUE PLACE OR POINT OF BEGINNING AS THUS ESTABLISHED, run thence North 65 degrees 23 minutes 26 seconds East a distance of 47.67 feet to a point; run thence South 24 degrees 36 minutes 34 seconds East a distance of 80.00 feet to a point; run thence South 65 degrees 23 minutes 26 seconds West a distance of 47.67 feet to a point; run thence North 24 degrees 36 minutes 34 seconds West a distance of 80.00 feet to a point, said point being the TRUE PLACE OR POINT OF BEGINNING

Lot 2

ALL THAT TRACT OR PARCEL OF LAND lying and being in Land Lot 290 of the 6th Land District, Gwinnett County, Georgia, being described as Future Building 3361 on Tract B on that certain Final Plat for Berkeley Lake Village, said plat being recorded on July 27, 2007 in Plat Book 121, Page 35, Gwinnett County, Georgia Records, said future being further described as follows:

BEGINNING at a point at the intersection of the Land Lot Line common to Land Lots 267 and 290 and the easterly margin of the right of way of Peachtree Industrial Boulevard (revised right of way with varying width); thence North 32 degrees 33 minutes 14 seconds East a distance of 702.89 feet to a point, said point being the TRUE PLACE OR POINT OF BEGINNING.

FROM THE TRUE PLACE OR POINT OF BEGINNING AS THUS ESTABLISHED, run thence North 65 degrees 23 minutes 26 seconds East a distance of 47.67 feet to a point; run thence South 24 degrees 36 minutes 34 seconds East a distance of 80.00 feet to a point; run thence South 65 degrees 23 minutes 26 seconds West a distance of 47.67 feet to a point; run thence North 24 degrees 36 minutes 34 seconds West a distance of 80.00 feet to a point, said point being the TRUE PLACE OR POINT OF BEGINNING.

Lot 3

ALL THAT TRACT OR PARCEL OF LAND lying and being in Land 290 of the 6th Land District, Gwinnett County, Georgia, being designated as Tract "A" containing 1.162 acres according to that certain Final Plat for Berkeley Lake Village, dated May 15, 2007, filed for record July 27, 2007 and recorded in Plat Book 121, Page 35, Gwinnett County, Georgia Records

Said property having been found to be in the possession of the defendant, Berkley Lake Partners, LLC, and levied upon as the property of the defendant in accordance with the Writ of Fieri Facias stated above. Levy made by Major David Parr, SO32 on December 2, 2008.

The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record, which may affect said property.

The sale will be conducted subject to confirmation that the sale is not prohibited under the United States Bankruptcy Code.

There will be sold at public outcry for cash or certified funds on the first Tuesday in January that being January 6, 2009 between the legal hours of sale, at the Gwinnett County Justice and Administration Center (GJAC), 75 Langley Dr., Lawrenceville, Georgia 30045 the following:

6 Cylinder, Green in color.

Vehicle may be viewed approximately one (1) hour before the time of sale in the rear of the front parking lot of GJAC. The actual sale will take place on the walkway leading to the front entrance of the Gwinnett Justice and Administrative Center (GJAC). Purchaser will be allowed one hour, if necessary, to obtain cash or official bank check, made payable to the Gwinnett County Sheriff's Department.

All sales are final and the vehicle must be picked up immediately after the sale. Georgia Sales Tax will be charged based on the county where the vehicle will be registered unless the purchaser presents a Georgia "Sales and Use Tax Certificate of Exemption Form" at the time of purchase.

This is a "buyer beware" sale and the property will be "sold as is". The sheriff makes no warranty, neither expressed nor implied, as to title. Purchasers cannot return the vehicle purchased. Purchasers, after successfully bidding for the vehicle, cannot "change their mind" and fail to pay for and pickup their purchase.

The sale will conducted subject to confirmation that the sale is not prohibited under the United States Bankruptcy Code.
