The Gwinnett County Board of Commissioners invites applications from all interested persons for the purpose of making appointments to the Gwinnett County Stormwater Authority to the following posts:

Members; Term Expires

1, 3, 5, 7; December 31, 2009

2, 4, 6; December 31, 2008

The Stormwater Authority shall consist of seven members who shall be resident freeholders of Gwinnett County and who shall either have scientific training or have demonstrated experience with stormwater issues. Five of the members of the Stormwater Authority, members 1 through 5, inclusive, shall be selected at large and appointed by the Board of Commissioners of Gwinnett County. Two members of the Stormwater Authority, members 6 and 7, shall be nominated by the majority vote of a committee composed of the mayor of each incorporated municipality that has agreed for Gwinnett County to provide stormwater services within its boundaries and shall be appointed to the Stormwater Authority by the Board of Commissioners of Gwinnett County. The initial terms of office members 1, 3, 5, and 7 shall be from their date of appointment until December 31, 2009, and until their respective successors are selected and qualified. The initial terms of office of members 2, 4, and 6 shall be from their date of appointment until December 31, 2008, and until their respective successors are selected and qualified. Thereafter, all members selected and appointed shall serve for a term of four years and until their successors shall have been selected and appointed.

Notice is hereby given to the public that the City of Sugar Hill, Georgia submitted two Resolutions, adopted by a majority of the governing authority of the City, instructing the City's Election Superintendent to call a Special Election for the purposes of the citizens of the City to consider the following questions or special referendum topics: (1) "Shall the Act be approved which authorizes the City of Sugar Hill to exercise redevelopment powers under the 'Redevelopment Powers Law,' as it may be amended from time to time, for the purpose of improving economic and social conditions in depressed areas within the city?" and (2) whether the city should increase its tax millage rate to create and fund its own municipal police department. Notice is hereby given to the public that the City of Duluth, Georgia submitted a Resolution, adopted by a majority of the Mayor and Council of the City, instructing the City's Election Superintendent to call a General Municipal Election to fill the expired terms of its Mayor and two Council Member seats. The Resolution further instructed that a Special Election for the Referendum Question: "Shall the Act be approved which authorizes the City of Duluth to exercise redevelopment powers under the 'Redevelopment Powers Law,' as it may be amended from time to time, for the purpose of improving economic and social conditions in depressed areas within the city?" The Resolution further directed that the City of Duluth utilize the Accu-Vote TS voting system currently used by the Gwinnett County Board of Elections which was previously pre-cleared for use by the Gwinnett County Board of Elections by the Department of Justice pursuant to the Voting Rights Act.

The submission was made on August 14, 2007 to the United States Attorney General for the purpose of pre-clearance pursuant to Section 5 of the Voting Rights Act of 1965, as amended. YOU ARE HEREBY NOTIFIED that on the 10th day of September, 2007, at 8:45 o'clock A.M. , in Courtroom 2-B, at the Gwinnett Justice and Administration Center, 75 Langley Drive, Lawrenceville, Gwinnett County, Georgia, before Judge R. Timothy Hamil of the Superior Court of Gwinnett County, will hear the case of the State of Georgia, Plaintiff, v. Development Authority of Gwinnett County and Notre Dame Academy, Inc., Defendants, Civil Action file No. 07-A-07643-8, in the Superior Court of Gwinnett County, the same being a proceeding to confirm and validate an issue of Development Authority of Gwinnett County Revenue Bonds (Notre Dame Academy, Inc. Project), Series 2007, in the aggregate principal amount of up to $7,500,000 (the "Bonds"). The Bonds are to be issued by Development Authority of Gwinnett County (the "Issuer") to (a) refinance the cost of the acquisition, construction and installation of land, buildings and personal property to be used as an early education center located on the campus of Notre Dame Academy (the "School"), (b) finance the cost of the acquisition, construction and installation of land, buildings and personal property to be used as elementary and middle school academic facilities located on the campus of the School (collectively, the "Project"), as more fully described in Exhibit D to the Loan Agreement (hereinafter described) and (c) pay all or a portion of the costs of issuance of the Bonds. The issuance of the Bonds to finance or refinance the Project is in furtherance of the public purpose for which the Issuer is created and will promote and expand for the public good and welfare industry and trade within the St ate of Georgia. The proceeds of the Bonds will be loaned by the Issuer to Notre Dame Academy, Inc., a Georgia nonprofit corporation, pursuant to a Loan Agreement, to be dated as of September 1, 2007 or as of the first day of the month in which the Bonds are issued. In said proceedings the Court will also pass upon the validity of said Loan Agreement, a Trust Indenture and a Letter of Credit in connection therewith.

Pursuant to O.C.G.A. Section 36-82-100, the Issuer hereby notifies all interested parties that no independent performance audit or performance review (the "Independent Audit") will be conducted with respect to the Bonds. However, the Company will ensure that the Bond proceeds are expended efficiently and economically intended by the Independent Audit.

Any citizen of the State of Georgia residing in Gwinnett County, Georgia, or any other person wherever residing who has a right to object, may intervene and become a party to this proceeding.

To Interested Agencies, Groups, and Persons:

On or about 15 days from the date of this publication, Gwinnett County, Georgia will request the U.S. Department of Housing and Urban Development to release Federal funds under the HOME Investment Partnerships Act [HOME Program/American Downpayment Initiative] at Title II of the Cranston-Gonzalez National Affordable Housing Act, as amended, 42 U.S.C. 12701 et seq., for the following housing activities/projects:

Single-unit acquisition, rehabilitation and construction; multi-unit rehabilitation; and, new homebuyer downpayment assistance.

Gwinnett County has determined that the HOME Program/American Dream Downpayment Initiative activities/projects will have no significant impact on the human environment, as many of the sites are unspecified at this time. All of the HOME Program or American Dream Downpayment Initiative activities/projects, as they are selected, will be subjected to environmental compliance using the HOME Program/American Dream Downpayment Initiative (ADDI) Site Screening Strategy and process. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) (P.L. 91-190, as amended) is not required.

This Environmental Review Record is on file at the Gwinnett County Community Development Program, 575 Old Norcross Road, Suite A, Lawrenceville, Georgia 30045-4367, and is available for public examination and copying, upon request, between the hours of 8:00 A.M.-5:00 P.M., Monday-Friday, during normal business days. No further environmental review of these activities/projects is proposed to be conducted prior to the request for release of HOME Program/American Dream Downpayment Initiative (ADDI) funds. All interested agencies, groups, and persons disagreeing with this decision are invited to submit written comments, for consideration by the County, to Ms. Tanikia Jackson, Official Representative for HUD Grant Programs, Gwinnett County Department of Financial Services, Gwinnett County Board of Commissioners, Gwinnett Justice and Administration Center, 75 Langley Drive, Lawrenceville, GA 30045 (Attention: Grants Section - HOME Program/ADDI Environmental Comment). Such written comments should be received at this address on or before September 17, 2007 . All such written comments received will be considered, and the County will not request any release of HOME Program or American Dream Downpayment Initiative funds from HUD, or take any administrative action on the activities/projects described, herein, prior to the date specified in the preceding sentence.

Gwinnett County will undertake the activities/projects described above with HOME Program and/or American Dream Downpayment Initiative funds from the U.S. Department of Housing and Urban Development, under Title II of the Cranston-Gonzalez National Affordable Housing Act, as amended, 42 U.S.C. 12701, et seq. Gwinnett County is certifying to HUD that the County and Ms. Tanikia Jackson, in her capacity as Gwinnett County's HUD Grant Programs Official Representative, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities concerning the environmental review process, and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, Gwinnett County may use the HOME Program and American Dream Downpayment Initiative funds, and HUD will have satisfied its responsibilities under the National Environmental Policy Act of 1969. HUD will accept an objection to its approval only if the basis is one of the following: (a) that the certification was not in fact executed by the certifying officer; or, (b) that applicant's environmental review record for the activities/projects indicates omission of a required decision finding or step applicable to the activities/projects in the environmental review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR 58) and may be addressed to HUD in care of HOME Program/ADDI Environmental Objections, U. S. Department of Housing and Urban Development, Atlanta Office of Community Planning and Development, Five Points Plaza, 40 Marietta Street, N. W. Atlanta, Georgia 30303-2806.

Objections to the release of funds on a basis other than those stated above will not be considered by HUD.

Objections may be submitted to HUD for a 15 day period after the County requests the release of funds on or about September 17, 2007. No objections received after 15 days, from HUD's receipt of the Request for Release of Funds from Gwinnett County, will be considered by HUD.
